1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Montessori Care website (www.montessoricare.com.au) and the services provided by Montessori Care Pty Ltd (ABN 60 633 980 140), a Registered NDIS Provider (Provider Number 4050113257), trading as Montessori Care (“Montessori Care”, “we”, “us”, “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

2. Services

Montessori Care provides aged care, disability care, and allied health services, including:

  • In-Home Aged Care
  • Support at Home
  • Disability Care
  • Allied Health Services
  • Early Intervention
  • Domestic Assistance
  • Personal Care
  • In-Home Nursing Care

The specific services provided to you will be outlined in your individual Service Agreement. All services are delivered in accordance with applicable Australian laws and regulations, including the Aged Care Act 1997, the National Disability Insurance Scheme Act 2013, the Aged Care Quality Standards, the NDIS Practice Standards, and other relevant quality and safeguarding requirements.

3. Service Agreements

Before commencing services, we will enter into a Service Agreement with you (or your authorised representative). This agreement will outline:

  • The services to be provided
  • The schedule of care
  • Fees and charges
  • Your rights and responsibilities
  • Our obligations

You may request changes to your Service Agreement at any time by contacting your care coordinator. Where these Terms and your Service Agreement conflict, the Service Agreement will prevail in relation to service-specific matters.

4. Fees and payment

Fees for our services depend on your funding arrangement:

  • Government-funded care: Fees are claimed from your NDIS plan or Support at Home funding. You may be required to pay a co-contribution depending on your assessed means.
  • Private care: Fees are charged at our published hourly rates. A detailed schedule of fees will be provided before services commence.

Invoices are issued fortnightly and payment is due within 14 days unless otherwise agreed in your Service Agreement. Late payments may incur additional charges, and we reserve the right to suspend services where invoices remain unpaid beyond the agreed terms.

5. Cancellation policy

We require a minimum of 24 hours’ notice for cancellation of scheduled services. Late cancellations or no-shows may be charged at the full service rate in accordance with NDIS pricing arrangements or your Service Agreement.

Either party may terminate the Service Agreement by providing written notice as set out in the agreement. Outstanding fees for services rendered up to the termination date will remain payable.

6. Your rights

As a client of Montessori Care, you have the right to:

  • Be treated with dignity and respect
  • Receive safe, quality care
  • Be informed about your care and make decisions
  • Choose your service providers
  • Have your privacy protected
  • Provide feedback or make a complaint without fear of retribution
  • Have a support person, advocate, or interpreter involved in your care
  • Change or terminate services at any time

7. Your responsibilities

To enable us to deliver safe, quality care, you (or your authorised representative) agree to:

  • Provide a safe environment for our staff, free from hazards, harassment, and abuse
  • Provide accurate and up-to-date information about your circumstances and care needs
  • Notify us of any changes in health, medication, living arrangements, or circumstances that may affect the delivery of services
  • Treat our staff with courtesy and respect
  • Provide reasonable notice for cancellations or schedule changes
  • Pay invoices in accordance with these
  • Terms and your Service Agreement

8. Our responsibilities

We are committed to providing services that are safe, person-centred, and aligned with your goals. We will:

  • Maintain appropriate insurance, including public liability and professional indemnity
  • Employ qualified and screened staff who hold current NDIS Worker Screening
  • Checks, Police Checks, and other required clearances
  • Comply with all relevant legislation, quality standards, and codes of conduct
  • Continuously improve our services based on feedback and best practice
  • Protect your privacy and personal information in accordance with our

9. Complaints and feedback

We welcome feedback and take complaints seriously. You can provide feedback or make a complaint by:

Montessori Care is committed to protecting your privacy. We adhere to the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) and our handling of personal information is governed by our Privacy Policy, which forms part of these Terms.

11. Website use

The content on our website is provided for general information purposes only. While we make every effort to ensure accuracy, we do not warrant that the information is complete, current, or error-free. The website should not be relied upon as a substitute for professional medical, legal, or financial advice.

You agree not to:

  • Use the website for any unlawful purpose
  • Interfere with the security or functioning of the website
  • Attempt to gain unauthorised access to any part of the website or our systems
  • Submit false, misleading, or harmful content through any website form
  • Copy, reproduce, or republish any content without our prior written consent

We reserve the right to suspend, modify, or discontinue any part of the website at any time without notice.

13. Limitation of liability

To the maximum extent permitted by law, Montessori Care’s liability under or in connection with these Terms or your use of our website is limited as follows:

  • We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, loss of data, or loss of opportunity
  • We are not liable for any harm or loss resulting from your failure to provide a safe environment, inaccurate information you have provided, or matters beyond our reasonable control (including but not limited to natural disasters, pandemics, government directions, power or internet outages, and acts of third parties)
  • Where our liability cannot be excluded but can be limited, our liability is limited to the resupply of the relevant services or the cost of resupplying those services

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify Montessori Care against any loss, damage, or claim arising from your breach of these Terms, your provision of false or misleading information, or your unsafe conduct toward our staff.

15. Modifications to Terms

Montessori Care reserves the right to update these Terms from time to time. We will notify clients of significant changes through your care coordinator or by email. Continued use of our services or website following any changes constitutes acceptance of the updated Terms. The “Last updated” date at the top of this page shows when the Terms were most recently revised.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

17. Entire agreement

These Terms, together with your Service Agreement (where applicable) and our Privacy Policy, form the entire agreement between you and Montessori Care in relation to your use of our website and services, and supersede any prior agreements or representations.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
